Definition of Terms

Wilderness canoe trips and classes on wilderness survival techniques, include : river and lake canoeing; swimming; hiking; fishing; the use of tools such as axes, knives and saws; mountain hiking, rock climbing and scrambling; nature observation and proximity to wild animals; crossing streams; carrying gear and equipment such as canoes; performing camp chores such as fire-lighting and other associated activities.

In consideration of Wild and Woolly's accepting my application, I agree to this Release of Claims and Waiver of Liability. I understand that wilderness canoe trips and wilderness survival classes involve certain dangers not all of which can be listed here. Among the more obvious and frequent are:

1. Inclement and unpredictable weather which might cause injury due to extremes of heat and cold, and which might prevent travel to, from or within an area;

2. Hazards of canoe travel on rivers and lakes;

3. Submersion in cold water resulting from a capsize or from falling out of a canoe;

4. Unfamiliar country where participants might become lost, get off route or become separated from the main party;

5. Remote location with poor communications and without quickly or easily accessible rescue or medical assistance;

6. Medical problems arising before, during or after the wilderness canoe trip or classes;

7. Illness related to a change in diet or water source;
8. Transport by public or private motor vehicle, boat, helicopter, or fixed-wing aircraft;
9. Natural hazards including those such as rock fall, flash flood, steep terrain, river debris, high wind and water conditions, and wild animals; and

10. Failure to follow directions from the guide, including specifically, directions to
    • stay with the group at all times unless the guide has been consulted and has consented
    • wear an approved personal flotation device completely fastened at all times on and around water, and
    • safe use of tools and other wilderness equipment.

I am not relying on any oral or written statements by Wild and Woolly to lead me to participate in this trip on any basis other than by my own assumption of the risks involved.

I accept all of the risks including the possibility of personal injury, death, property damage and property loss which might result from my trip with Wild and Woolly.

I release Wild and Woolly, its owner and operator, its guides, employees, agents and representatives from any and all liability for any personal injury, death, or property damage or loss I might experience as a result of my participation in their trip for any cause whatsoever, including negligence, by Wild and Woolly, its owner and operator, guides, employees, agents and representatives.

I certify that I am physically capable and fit to participate in this activity and that I have no medical needs or conditions other than those listed in the Medical Information Form provided the Wild and Woolly.

I confirm that I am eighteen years of age or older. (Younger participants must have a parent or guardian read and sign this document.)

I confirm that I read this agreement before signing, that I understand it and that it will be binding on me, my heirs, my next of kin and on my executors, administrators and assigns.

I agree that the laws of the Yukon Territory govern this contract and that any legal concern will be handled in the fair and competent courts of Whitehorse, Yukon Territory, Canada.
